The Necessity for Allodium 

Introduction

Allodium refers to a form of holding property in which full title is vested in a clearly identifiable party, without division of interest or dependency on a superior holder.

Historically, allodial title described land held free from feudal obligation, where no superior landlord or external claim governed the tenure.


Modern Title Structures

In contemporary property systems, title is often divided into distinct interests, commonly referred to as legal title and equitable title.

This separation allows different parties to hold different rights or interests in the same property, depending on the structure of agreements, financing arrangements, or administrative recording systems.

As a result, the relationship between property and its recorded ownership can become layered and complex, particularly where multiple interests or transfers are involved.


Position of Allodial Title

Allodial title represents a unified position, where interest in a property is not divided into separate layers but instead reflects a single and complete relationship between the property and its holder.

When a property is held in this manner, it is described as being “in allodium,” indicating that the title is not derived from, or dependent upon, a superior interest.


Application Within This Context

A Certificate of Allodial Title is issued to associate the physical property with a defined and identifiable holder.

This certificate serves as a formal expression of the relationship between the property and the holder within a private context.

It operates alongside existing title systems, providing an additional layer of clarity in how the property is identified and related to.


Landed Property and Conveyances

Allodial title may be applied to both landed property and private conveyances, where a clear and direct relationship between the asset and its holder is established.

The focus is not on replacing existing commercial title records, but on defining a structured and intentional position in relation to the physical property itself.


Relationship to the cLPT and Sovereignty Certification

Allodial title operates in conjunction with the broader structure established through the cLPT and Sovereignty Certification.

Where the cLPT defines how an estate is organised and administered, Allodial Title defines the position of the property within that arrangement.

Sovereignty Certification provides recognition of the individual, the cLPT establishes the trust arrangement, and Allodial title expresses the relationship between the holder and the property.

Together, these elements form a coherent system of recognition, structure, and positioning.
